Paul E. Godinez represents both institutional and startup clients with respect to the acquisition, development, protection, transfer and licensing of IP, information technology, software, data and other content.
Paul was previously Counsel to American Express in the Technology & Digital Law Group, where he advised on and negotiated Amex's complex strategic alliances with digital platforms, and guided business teams in navigating the dynamic legal and regulatory environments of a financial institution.
Paul spent the first nine years of his career as an IP and white collar litigator at White & Case, and then served two years as Chief Operating Officer and General Counsel of a NY-based digital advertising agency.
Paul routinely advises clients on a variety of issues and subject matters covering technology & content licensing, IP registration and enforcement, regulatory and compliance programs, and the myriad of legal issues related to social media, marketing in the digital space, and Web 2.0. His recent work in the digital space has covered technology & development agreements, API licensing, data security and privacy implications of digital payment products, strategic promotions, and marketing arrangements, including the implications of co-mingling data, brand positioning and external communications, social media strategy, go-to-market strategy and the creation and governance of interactive law issues such as behavioral advertising, E-Sign, user generated content, and social media risk mitigation.
Since October 2014, Paul has served as outside General Counsel to Waterfall International Inc., a San Francisco, CA-based mobile messaging provider which hosts a cloud-based software platform that enables brands and technology providers to manage both enterprise mobile messaging communications (e.g., short message service (SMS), multimedia messaging service (MMS), and push notifications) and customer relationship management (CRM).
